In Kansas, the following tables describe the penalties related to the first and each subsequent DUI arrest. Some courts offer diversion for first time DUI arrests, which is not mentioned in these tables. If diversion is available, the details of qualifying for the diversion vary by court. Third Occurrence
1-year suspension, followed by 1-year restriction with ignition interlock device. $300 license reinstatement fee.
3- year license suspension. $800 license reinstatement fee.


Fourth Occurrence
1-year suspension, followed by 1-year restriction with ignition interlock device. $400 license reinstatement fee.
10-year license suspension.$1,000 license reinstatement fee.


Fifth Occurrence
Driving privileges permanently revoked.
Driving privileges permanently revoked.

 

If a person fails a test or has an alcohol or drug-related conviction in this state AND the person's blood or breath alcohol concentration is 0.15 or greater, the division shall:

1-year suspension, followed by 1-year restriction with ignition interlock device.

Second Occurrence
1-year suspension, followed by 2-year restriction with ignition interlock device.

Third Occurrence
1-year suspension, followed by 3-year restriction with ignition interlock device.

1-year suspension, followed by 4-year restriction with ignition interlock device.

Fifth or Subsequent Occurrences
Driving privileges permanently revoked.

If a person who is less than 21 years of age fails a test OR has an alcohol or drug-related conviction in this state, the division shall:

1-year suspension, followed by 4-year restriction with ignition interlock device.

Driving privileges permanently revoked.
